The court granted our health care client’s motion to dismiss former employee’s constructive termination, retaliation, and intentional infliction of emotional distress counterclaim. The court also denied the former employee’s motion to dismiss our client’s breach of contract claims and to disqualify Plaintiff’s counsel. The case was promptly settled for all amounts due our client for breach of contract plus attorney’s fees following the court’s decision.
